McLaren try out nose horn wings
http://www.autosport.com/news/report.php/id/69429
after evaluating a shark fin engine cover in Hockenheim testing, the team surprised observers on the third day of this week's test at Jerez in Spain by unveiling bold-looking nose wings fitted to their car .
The sculpted wings, which rise out of the top sides of the nose on the car, are based on a concept used by BMW Sauber and Honda Racing.

Um... there are.
The UK High Court prevented Arrows from racing the FA/1 on the grounds that it was a copy of the Shadow DN9. As for the Ligier JS41, the Sauber C23, and more recently the cases of Super Aguri and Toro Rosso, the courts have ruled that the IP was owned by the respective teams for what is essentially copies.
As for the question of whether the horns fitted to the front of the MP4-23 constitute a violation of IP, well the short answer is that you can't actually patent an idea; the long answer is well beyond the scope of this forum.

As long as something is 'inspired' by a particular design and not directly copied then there is no problem.
